I. NATURE OF CASE

Gary Riesen brought suit against his former employer, Irwin Industrial Tool Company (Irwin Industrial), alleging he was fired in retaliation for filing a workers’ compensation claim. The trial court granted summary judgment for Irwin Industrial, and Riesen appealed.

In this opinion, we conclude that Riesen met his burden of establishing a prima facie case of retaliatory discharge for filing a workers’ compensation claim. We also conclude that Riesen’s evidence, viewed in a light most favorable to Riesen, created a genuine issue of fact as to whether the…
