FLAUM, Circuit Judge.

Walter Barnes pled guilty to one count of conspiracy to possess with intent to distribute cocaine and to one count of distribution of cocaine. The district court sentenced Barnes to three years on the distribution count, but suspended the imposition of sentence on the conspiracy count. After his release, Barnes violated the terms of his parole and was sentenced to an additional five-year term of imprisonment on the conspiracy count. However, this Court, for reasons unrelated to this appeal, vacated that sentence and remanded for resentencing. On remand, the court again…
