Affirming.

Sometime in the early part of 1904 appellee, Geo. Estes, purchased from one Sparks, who was agent for some heirs, the tract of land the right of possession to which is in dispute in this action, and paid the purchase price, $2,500, therefor. Before the time of the purchase, John Estes, appellant, was looking over the land with ■the view of buying it, but had no means with which to pay for it.
