Concerning the material facts of this case there is no disagreement between the parties. Orval Pool died June 30, 1871, leaving him surviving Madeline Pool, his widow, and Maty Pool Docker, Marshall M. Pool, Ellen Pool Peeples, and Augusta M. Pool Townshend, his children and only heirs at law. The estate left by decedent was quite large, and consisted of lauds, bank stock and other personal property. By the terms of his will the testator gave the largest portion of his estate to his two children Marshall and Augusta, but made some provision for his wife and his other daughters. Madeline Pool,…
