delivered the opinion of the Court.:

This suit was commenced in the county court of Mercer county, sitting for the transaction of probate business, where judgment was rendered in favor of appellee. Appellants took the case, by appeal, to the circuit court of that county, where a like judgment ivas rendered as in the county court, from which, by appeal, they bring the record before us.
