From Coos: John S. Coke, Judge. This is an action by John A Parker, administrator of the estate of George H. Parker, deceased, against the C. A. Smith Lumber & Manufacturing Company, a corporation, and the City of Marshfield, a municipal corporation. From a judgment for the defendants, plaintiff appeals. The facts are set forth in the opinion of the court.

The plaintiff, as administrator of the estate of George H. Parker, deceased, who died intestate on the 19th day of August, 1912, from the effects of an injury received by him on the morning of August 18, 1912, in the City of Marshfield, brought this action to recover $7,500, as damages for the death of the decedent, claiming that his death was caused by the negligence of the defendants.

*44The defendant the C. A. Smith Lumber & Manufacturing Company is a corporation, and the defendant the City of Marshfield is a municipal corporation of this state.
