PALMIERI, District Judge.
This action arises out of a commercial transaction between plaintiff and defendant and involves an allegedly unjustifiable delay in defendant’s delivery to plaintiff of plastic fishing rod handles. Plaintiff is an individual who is a citizen and resident of the State of New York. He is engaged in the business of making and selling toys and fishing tackle. His office is located in New York, and his workshop is located in Lawrence, Massachusetts.
