SARIS, District Judge.
INTRODUCTION
Plaintiff National Credit Union Administration (“NCUA”), in its capacity as liquidating agent of Barnstable Community Federal Credit Union (“BCFCU”), seeks a declaratory judgment that the title insurance policy issued by defendant, Ticor Title Insurance Company (“Ticor”) to BCFCU on a Cape Code motel is in full force and effect. It has also asserted a breach of contract claim.
