Error to the court of Common Pleas of Dauphin county, in an ejectment, brought by the plaintiff below, Innis Green, administrator cum testamento annexo, of Robert MlCord, deceased, against Thomas D. Cornell, James Urmstrong and John Sawyer, the defendants below, in which a verdict and judgment were rendered in favour of the plaintiff. Exceptions were taken by the- defendants below, to the opinion of the court, on points of evidence, and also to their charge.

Robert M‘Cord, by his will, directed his real and personal estate to be sold, and distributed in a particular way by his executors; one of whom died intestate before any sale was made. The survivor sold the tract of land for which this ejectment is brought, at public sale, to James Armstrong and John Sawyer, for 5,990 dollars; a great part of which was paid.
