O’NEAL, Justice.

This is an action sounding in toft for damages growing out of a grade crossing accident and collision between an automobile and a switch engine owned and operated by the defendant, Railway Company.

Thomas J. Clark, plaintiff below, will be referred to as plaintiff, and the Kansas, Oklahoma & Gulf Railway Company, a corporation, will be referred,to as the de-, fendant, or in the alternative, as the Railway Company.
