Appeal from an order of the County Court of St. Lawrence County (Nicandri, *821J.), entered December 12, 1988, which granted defendant’s motion to suppress evidence.

The issue before us is whether County Court correctly held that the blood test taken from defendant was not in conformity with Vehicle and Traffic Law § 1194 (1) and must be suppressed. The facts disclose that defendant, the driver of one of two cars involved in a collision on December 4, 1987 which left his three passengers dead, was taken from the scene to the hospital for treatment.
