Tarbell, J.:
At the July special term of the Scott county circuit court, for 1869, the plaintiff in error was indicted for a violation of the provisions of the Code regulating “ the sale of vinous and spirituous liquors.” At the October term of the same year, the cause came on to he tried, when the defendant submitted a motion to quash the indictment, which being denied, the defendant excepted, and pleaded not guilty.
