EAGER, Judge.

This appeal is one from an order denying a motion to vacate a judgment and sentence, filed pursuant to Criminal Rule 27.26, V.A.M.R. Defendant is confined in the penitentiary. The sentence was one for two years imposed on June 15, 1962, for driving a motor vehicle while intoxicated. See Sections 564.440 and 564.460 RSMo 1959, V.A.M.S. (to which revision all statutory citations will refer unless otherwise stated).
