PONDER, Justice.

The defendant was charged in a bill of information with “the crime of gambling as defined in LSA-R.S. 14:90 in that he did unlawfully and intentionally conduct and directly assist in conducting, as a business, at Treme and St. Peter Streets, in the City of New Orleans, of a lottery, whereby a person risked the loss of a thing of - value in order to realize a profit.” On trial he was convicted and sentenced to pay a fine of $500 and serve one year in the- Parish Prison and in default of payment of fine to serve an additional six months in the Parish Prison.
