HARVEY, Judge.

This is a suit by Mrs. Mary O. Lovejoy, surviving wife of John Lovejoy, deceased, and the residuary devisees named in the will of the deceased, to recover of the defendant in error, Ernest Cockrell, an undivided half of a tract of five acres of land in Chambers county. The case went to trial before a jury, but at the conclusion of the testimony, the trial court ruled that no jury question was raised by the testimony, withdrew the caso from the jury, and gave judgment for Mrs. Lovejoy, for one half of said undivided half sued for, and gave judgment in favor of Cock-rell for the…
