This action is before the undersigned based on the consent of the parties. See Dckt. No. 18; see also E.D. Cal. L.R. 305; 28 U.S.C. § 636(c). Defendants move to dismiss plaintiffs Family Medical Leave Act (“FMLA”) claim against defendant Dr. Scott Hundahl pursuant to Federal Rule of *1005Civil Procedure (“Rule”) 12(b)(6) for failure to state a claim.
