Appeal by the plaintiffs, Robert K. Richards, individually, etc., and another, from a final judgment of the Supreme Court in favor of the defendants, entered in the office of the clerk of the county of Queens on the 24th day of May, 1909, upon the decision of the court rendered after a trial at' the Queens County Special Term.

Carr, J.:
The plaintiffs are the owners of a large trad; of farming land in the third ward of the borough of Queens, which abuts upon a public road known as the Black Stump road, for a distance of 2,249 feet, to the center of which road they have title in fee simple absolute, subject to the highway easements. The third ward of the borough of Queens, prior to January 1, 1898, was the town of Flushing. On the last-mentioned date it became a part of the city of Rew York by virtue of the provisions of the “ Greater Rew York Charter.” (See Laws of 1897, chap. 378, §§ 1, 1.611.) The Black Stump road…
