HICKS, Circuit Judge.

About January 1, 1913, First National Bank of Detroit created the “Pension Fund of the First National Bank of Detroit” to provide pensions for its officers and employees, their widows and children. Rules and regulations adopted for the administration of the fund were in effect on February 11, 1933. On that date defendants' Clark, Hoppin, McLeod, Mon*111aghan, Shelden, Sweeny, and Wilson were trustees of the fund, and its assets of the face value of approximately $325,000 were in their custody and under their control.
