MEMORANDUM OPINION

CROWLEY, District Judge.

The defendant, Eugene Hairston, has been indicted for a violation of 18 U.S.C. § 922(h) for receipt of a firearm by one having previously been convicted of a felony. Before the court at this time is defendant’s motion to suppress.

On February 11, 1977, at approximately 2:00 p. m., Officers Alonso and Drake, Special Operations Group, Chicago Police Department, were on patrol in the area of 49th Street and Michigan Avenue in Chicago, Illinois.
