INTRODUCTION

Plaintiffs, Beverly Dermady (“Mrs. Der-mady”) and The Estate of Edward F. Der-mady, commenced this action under the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1001. et seq. Plaintiffs allege that defendants, Eastman Kodak Company (“Kodak”), the Kodak Retirement Income Plan Committee (“KRIP-CO”), and the Kodak Retirement Income Plan (“the Plan”), provided plaintiffs with inadequate and misleading information concerning plaintiffs’ rights and obligations under the Plan relating to the benefits to which Mrs. Dermady would be…
