MEMORANDUM OPINION

ALBRITTON, Chief Judge.

This action concerns a dispute over long-term disability benefits. On May 20,1996, the plaintiff/counterelaim defendant, Cooperative Benefit Administrators, Inc. (“CBA”), filed its complaint in this action. As amended on October 17, 1996, the complaint states that CBA seeks reimbursement of certain long-term disability benefits paid by the National Rural Electric Cooperative Association (“NRECA”) Long-Term Disability Plan (“LTD Plan”) to the defendant/counterelaim plaintiff, Ronald Whittle (“Whittle”).
