MEMORANDUM DECISION AND ORDER

This matter is before the court on Defendant Arthur Anderson & Company’s (“Defendant”) Motion to Dismiss under Rule 4(j) of the Federal Rules of Civil Procedure (“FRCP”), Defendant’s Second Motion to Dismiss, and Plaintiff Timothy A. Cloyd’s (“Plaintiff’) Motion to Enlarge Time to Serve Summons and Complaint (“Motion to Enlarge Time”). No hearing was requested concerning these motions and the court deems such unnecessary.
