This matter arises from an action brought by General Mechanical Contractors, Inc. (hereinafter “General Mechanical”) seeking reimbursement of surety bonds purchased in order to proceed on a construction project in Lexington, Massachusetts. The defendant, CTA Construction Company, Inc. (hereinafter “CTA”), contends that they are not required to reimburse General Mechanical for the surety bonds.
