Appellee, as administrator of the estate of John Crowder, sued appellant for money held by him in trus¿ for the use of said estate.

The complaint contains a long history of transactions, commencing as far back as 1838, which we can not see affect the merits of the real matters in controversy. The complaint contains three paragraphs, which are substantially the same, and the parties have called our attention to the third one.
