Appellants, Charlie Burrows and his wife, brought this suit against the Texas &• New Orleans Railroad Company and Nacogdoches county, jointly, and alleged that said railroad and county were operating a stock pen and dipping vat near their home in the city of Nacogdoches; that said stock pen and dipping vat were constructed together and were being operated conjunctively. They alleged that said stock pen and dipping vat constituted a nuisance, and prayed for an injunction against both defendants restraining them from operating same, and in the alternative, in the event the injunction was…
