delivered the opinion of the Court.(1) The trial judge sustained a demurrer to a petition for condemnation for park purposes of farm lands on the ground, in substance, that the lands are not so near the City as to be within the power of the City to condemn.' The determination of the controversy involves a construction of Subsection 3, Section 1, Chapter 426 of the Private Acts of 1927, the pertinent portion thereof reading as follows:
“The board of Park Commissioners of the City of Nashville, Tennessee, is hereby authorized to establish parks in such localities as it may determine, either…
