Plaintiff, Heffernan, was captain of the police in Janesville. On July 20, 1942, a complaint alleging twenty-two separate items of misconduct by Heffernan was presented to the Board of Police & Fire Commissioners of Janesville for investigation and determination. A formal hearing was had in which voluminous testimony was offered and the board found Heffernan guilty of misconduct in respect to seventeen items or counts established by the evidence.
