Actiok to determine ownership of a mill erected by plaintiff in error on certain mining properties belonging to the defendant in error. The trial court found the issues generally in favor of the defendant in error. The action below was instituted to restrain another defendant, the Monitor Grold Mining Company, from dismantling and removing the mill. The latter sought to justify its action on a claim of ownership in itself through purchase from Webb.
