Plaintiff brought this action under the admiralty jurisdiction of the superior court to recover damages for injuries alleged to have been sustained when he slipped and fell on a landing or float, owned and maintained by defendants, after he had disembarked from a tug operated by defendants which had transported him from Vallejo to Mare Island, where he was employed by defendants as a pile driver in the construction of a wharf or pier. The trial court granted defendants’ motion for nonsuit on the ground that the Industrial Accident Commission had sole and exclusive jurisdiction of the case;…
