This is an unusual proceeding under the 1980 Hague Convention on Civil Aspects of International Child Abduction (19 ILM 1501, reprinted in 51 Fed Reg 10498, Appendix B) (hereinafter Hague Convention). Unusual even given the fact that the Hague Convention and its application in the United States is still relatively new. The proceeding is apparently one of first impression concerning the term "habitual residence” as used in the Hague Convention.
