This is an action for damages on an alleged conspiracy to defraud.

Plaintiffs, in their complaint, allege, in substance, that during the early part of the year of 1929 they were the owners of an auto park consisting of five acres of real property with certain buildings thereon and certain personal property used in conjunction therewith, consisting of stocks of merchandise, and necessary equipment and utensils and paraphernalia and a small menagerie.
