JOURNAL ENTRY AND OPINION Plaintiff-appellant Stanley Kline ("Kline") appeals from the granting of defendant-appellee Ronald Ducato's ("Ducato") motion to dismiss pursuant to Civ.R. 12(B)(6). For the reasons adduced below, we reverse and remand for further proceedings.
