The plaintiff brought this action on behalf of himself and “others similarly *105situated” seeking to recover statutory-damages for alleged violations of the Truth in Lending Act, 15 U.S.C. § 1601 et seq.
The violations are claimed to have occurred as a result of an agreement between the defendants whereby the defendant bank purchased promissory notes or retail installment contracts from the defendant spa at discounts.
