Plaintiff obtained an order for executory process on a note for $1,200 of date October 12, 1908, secured by mortgage; both note and act of mortgage having been executed by Mrs. Mary E. Goldsmith and three of her children by a previous marriage, to wit, Sue Virginia Tilton, appearing as the divorced wife of James R. Bass, Aloys Mary (known as Alice) and Newell, Til-ton, emancipated minors, and the property purporting to have been mortgaged being two lots of ground in this city.
