Appellant appeals from a denial of his writ of habeas corpus by the Honorable John Grimball, Judge of the Fifth Judicial Circuit.

On April 4, 1962, Louis Moorer, a Negro, was convicted of the offense of rape in the Court of General Sessions for Dorchester County and sentenced to death as provided by the laws of the State of South.
