This is an appeal from a judgment in favor of plaintiff in the sum of $2,326.99 and costs entered after trial before the court without a jury in an action to recover damages for breach of an oral contract of employment for one year.

Facts: Defendant employed plaintiff to be the manager and buyer of his shoe store for the period of one year commencing on the 27th day of August, 1948, at a salary of $100 per week plus a sum equal to 1 per cent of the gross business conducted each calendar month.
