This is an action wherein the plaintiff and appellant seeks to recover damages by reason of the alleged negligence of defendant and respondent in refusing and neglecting to make reasonable effort to collect a certain collateral note, and to enforce a certain chattel mortgage securing payment of said collateral note, which collateral note and mortgage had been delivered to defendant as security for the payment of a principal note made to defendant, Empire Trust Company, by one J.P.
