On the 24th day of April, 1909, relator presented to respondent a liquor dealer’s bond in proper form and properly approved, tendered $500 in money, and demanded the usual receipt in accordance with Act No. 313, Pub. Acts 1887. Respondent refused to receive the bond and money, or to give the receipt, upon the ground that the manufacture and sale of intoxicating liquors had been prohibited after the 1st day of May, 1909, by a vote of the electors of the county at the local-option election *65held on the first Monday in April, 1909.
