This appeal was taken by the plaintiff in error from an order of the district court denying his motion to set aside a sheriff’s sale of real estate made in pursuance of a decree entered in a partition suit. The parties to this appeal were both parties to the partition suit, and after a decree had been entered in the partition suit appointing appraisers to appraise the land and after the same had been appraised for $1,170, each of the parties filed an election to take the property at the appraised value.
