Lovins, Judge:

This action was instituted by Benny Divita to recover damages for personal injuries resulting from a highway collision between an automobile owned by plaintiff and driven by his employee, in which he was riding and a motor truck owned by defendant, Atlantic Trucking Company. To a judgment of the Circuit Court of Fay-ette County, entered on a jury verdict in favor of plaintiff in the amount of thirty-five hundred dollars, defendant, Atlantic Trucking Company, prosecutes this writ of error.
