This matter is before the court on motions to dismiss pursuant to Fed.R.Civ.P. 12(b)(6) by defendants MERSCORP, Inc. (“MERS”), Litton Loan Servicing, LP (“Litton”), Johnson & Freedman, LLC, and January N. Taylor (“J & F defendants”) (DE 144, 166, 175), and the motion to dismiss pursuant to Fed.R.Civ.P. 12(b)(5) by the Bank of New York-Mellon (“BNY”) (DE 170).
