This is an appeal by the plaintiff and cross-defendants from a judgment against them in an action by which Bernardino de Bairos, as assignee of the other cross-defendants, sought to recover from the defendant $1,-069.65, the sum of unpaid installments under three contracts for the sale of real property. Under these contracts, cross-defendants, E. B. & A. L. Stone Company and Jennie F. Stone, are vendors, and the defendant is the vendee of a parcel of land in a subdivision of Stonehurst, Brooklyn township, Alameda County, California.
