—In an action to recover damages for wrongful death, etc., the plaintiff appeals from an order of the Supreme Court, Orange County (Owen, J.), dated October 4, 1995, which granted the defendants’ motion for summary judgment dismissing the complaint. Justice McGinity has been substituted for the late Justice Hart (see, 22 NYCRR 670.1 [c]).

Ordered that the order is affirmed, with costs.
