This is an appeal from a judgment of the City Court of Albany (67 Misc 2d 508 [Lavigne, J.]) granting judgment to the plaintiff for the amount of down payment on the contract in question plus $100 statutory allowance and $250 counsel fees. The Attorney-General filed a memorandum with a request that he be permitted to intervene as amicus curiae. That permission is granted and the Attorney-General’s brief is taken into consideration herein.
