LUTTIG, Circuit Judge:

The United Auto Workers, Local 5285 (UAW), appeals the dismissal of its suit under 42 U.S.C. § 1983 alleging that its First Amendment rights were violated when it was denied an information booth at an annual festival organized by a private corporation in Gastonia, North Carolina. The district court dismissed the suit after holding that the festival’s organizer, Gaston Festivals, Inc. (GFI), is not a state actor and thus is not subject to the requirements…
