OPINION
WALLS, District Judge.
This matter comes before the Court on appeal from a decision of the Bankruptcy Court, and raises three difficult procedural issues.
BACKGROUND
On January 26, 1995, defendant-appellee Garabet Cirkinyan, who had been a diamond setter, filed for relief under Chapter 7 of the Bankruptcy Code. The creditors, Philmar Jewelers, Inc., A.S.K.
