The appellant, Clator, seeks a reversal - of the judgment of the municipal court of the 'city of Wheeling,, rendered May 18, 1874, in an action of covenant, instituted by Brodie, against him.

The action was based upon an article of agreement,, made between Brodie and Clator, dated 13th September, 1869, which stipulated, “That John Clator, party of the second part, agrees to furnish the material and do^ all .the work of plastering at J. M. Brodie’s house, on Quincy street, at full book of plasterer’s prices, in payment of which J. M. Brodie agrees to furnish all material and do…
