These are separate actions on the case, brought by appellees against appellant, to recover damages for personal injuries alleged to have been by them sustained through the negligence of appellant in the operation of its coal mine, in which appellees were employed as miners. By agreement, the causes were tried together, and the pleadings and evidence are the same in each case. The trial resulted in a judgment in favor of appellee John E. Shepherd for 85,000, and in favor of appellee Charles L. Shepherd for §1,500, from which judgments…
