GRAVES, Judge.
Appellant was charged with the murder of Willis Wilemon, and by the jury convicted and assessed the death penalty.
It appears from the testimony that appellant, who lived at Bonham, Texas, visited the town of Maypearl, in Ellis County, on Monday, May 8, 1939, and the following Tuesday and Wednesday, with the purpose of familiarizing himself with the localities and surroundings, eventually looking towards robbing the Maypearl bank.
