In August 1985 the United States charged defendant Charles Gentile with travelling in interstate commerce to facilitate an unlawful activity, in violation of 18 U.S.C. § 1952(a)(3) (1982), and with possession with intent to distribute cocaine, in violation of 21 U.S.C. § 841(a)(1) (1982). Following a jury trial in March 1986, Gentile was acquitted by the jury of the travel-ling in interstate commerce charge; on the possession charge, however, the jury was unable to reach a unanimous verdict.
